This document governs your registration, installation, and ongoing use of the BIM VPN software and services. By installing BIM VPN you agree to these terms.
This Registration Protocol ("Protocol") governs your use of the BIM VPN software, applications, and related services (collectively, the "BIM VPN Services"). This Protocol is a legally binding agreement between you ("User") and BIM VPN Team ("BIM VPN," "we," "us," or "our").
By downloading, installing, or using BIM VPN in any way, you confirm that you have read, understood, and agree to be bound by this Protocol in its entirety. If you do not agree to any of the terms herein, you must immediately uninstall and cease using the BIM VPN software.
This Protocol applies to all versions of the BIM VPN software, including desktop clients for macOS and Windows, mobile applications for iOS and Android, and any web-based components. It supplements and should be read in conjunction with the BIM VPN Terms of Service and Privacy Policy, both available at bimvpn.xyz.
The BIM VPN website, all software applications, documentation, branding, logos, design elements, and all other materials associated with the BIM VPN Service are protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws.
All intellectual property rights in and to the BIM VPN Service are reserved to or licensed by BIM VPN Team. The BIM VPN name, logo, and all associated marks are trademarks of BIM VPN Team. You may not use any BIM VPN trademark, logo, or branding in any manner that suggests endorsement by or affiliation with BIM VPN without prior written consent.
Nothing in this Protocol transfers any intellectual property rights to you. Your use of the Service does not grant you any ownership interest in the software or any of BIM VPN's intellectual property. Any feedback, suggestions, or ideas you provide regarding the Service may be used by BIM VPN without any obligation to you.
Subject to your compliance with this Protocol and the payment of applicable subscription fees, BIM VPN grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the BIM VPN software on any personal computer or mobile device associated with your account, up to the number of simultaneous devices permitted by your subscription plan. This license permits personal or internal business use only.
All rights not expressly granted to you in this Protocol are reserved to BIM VPN. You may not sublicense, sell, resell, transfer, assign, distribute, or otherwise commercially exploit the Service or make it available to any third party. You may not modify or create derivative works based on the Service or its components.
BIM VPN may, from time to time, integrate or make available third-party services, tools, or platforms as part of or alongside the Service. Your use of any such third-party services is governed by the separate terms and privacy policies of those third parties. BIM VPN is not responsible for any third-party service's availability, accuracy, or compliance with applicable law.
You must only download and install BIM VPN software from official BIM VPN distribution channels, including the official website at bimvpn.xyz, the Apple App Store, the Google Play Store, or any other channel officially designated by BIM VPN. Software obtained from unofficial sources may be counterfeit, modified, or malicious. BIM VPN is not responsible for any harm resulting from software obtained through unofficial channels.
a. Account Confidentiality
You are responsible for maintaining the confidentiality of your account credentials, including any username, password, or activation code associated with your BIM VPN account. You agree not to share your account credentials with any third party. Any activity that occurs under your account is your responsibility, whether or not you authorized such activity.
b. Account Disputes
If you believe your account has been compromised or that someone else is using your account without authorization, you must notify BIM VPN support immediately at support@bimvpn.xyz or via Telegram at @bimvpn. BIM VPN will investigate and take appropriate action, but cannot guarantee that unauthorized use will be prevented or reversed.
c. Inactive Accounts
BIM VPN reserves the right to deactivate or delete accounts that have been inactive for an extended period, particularly if associated with an expired subscription. BIM VPN will make reasonable efforts to notify you before deactivating your account. Reactivation may require starting a new subscription.
d. Account Deletion
You may request the deletion of your BIM VPN account at any time by contacting support. Upon deletion, your subscription access will be immediately terminated and any associated data retained by BIM VPN will be deleted in accordance with our data retention policies. Account deletion does not entitle you to a refund of any prepaid subscription fees.
Your use of the BIM VPN Service must comply with all applicable laws and regulations and must not infringe the rights of others. The following activities are expressly prohibited:
User responsibility for local laws. You are solely responsible for compliance with the laws of the country or territory in which you use the Service. BIM VPN makes no representation that the Service is legal or appropriate for use in any particular jurisdiction.
Violations result in immediate termination without refund. Violation of this Acceptable Use Policy may result in immediate suspension or permanent termination of your account without prior notice and without refund of any prepaid subscription fees. BIM VPN also reserves the right to pursue applicable legal remedies.
BIM VPN does not log your internet traffic, browsing history, email communications, phone number, or any other personally identifiable information related to your use of the VPN tunnel. We operate a strict no-logs policy: we have no record of what websites you visited, what files you downloaded, or what content you transmitted while connected to BIM VPN.
BIM VPN may use third-party diagnostic and analytics services in a generic, aggregated manner to help monitor and improve Service performance. These services receive only anonymized technical information and cannot identify you personally.
BIM VPN's website and marketing pages may use third-party cookies and tracking technologies for standard web analytics purposes. These technologies operate at the browser level and are not connected to your VPN usage. You can manage or opt out of such tracking via your browser settings. BIM VPN reserves the right to modify, update, replace, or discontinue any aspect of the Service or the software at any time, with or without prior notice. Such changes may include security updates, new features, bug fixes, or adjustments required by law.
By installing and using BIM VPN, you agree to receive and accept software updates when connected to the internet. These updates are necessary to ensure the security and functionality of the Service. Refusing to install updates may result in reduced functionality or the inability to use the Service.
BIM VPN is not liable for any disruption to the Service caused by the installation of updates, or for any incompatibility between updates and third-party software on your device.
Access to the BIM VPN Service requires a valid paid subscription unless you are using a free trial or promotional access granted by BIM VPN. By subscribing to a BIM VPN plan, you agree to the pricing and terms of the plan as displayed at the time of purchase.
Pricing may change with notice. BIM VPN reserves the right to change subscription pricing at any time. Any price change will be communicated to existing subscribers in advance through the app or by email, and will take effect at the next renewal period. Your continued use of the Service after a price change takes effect constitutes your acceptance of the new pricing.
No refunds on virtual products. All subscriptions to BIM VPN are for virtual digital services that are delivered immediately upon purchase. As such, all sales are final and no refunds will be issued once a subscription period has commenced, except as required by applicable consumer protection law in your jurisdiction. If you experience a technical issue preventing you from using the Service, please contact our support team and we will work to resolve it.
Subscriptions may be renewed manually or automatically depending on the platform and payment method. It is your responsibility to cancel before the renewal date if you do not wish to be charged for the next period.
THE BIM VPN SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. BIM VPN disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.
No warranty of continuous availability. The Service may be interrupted, suspended, or terminated at any time due to technical issues, maintenance, or circumstances beyond BIM VPN's control. BIM VPN does not guarantee uninterrupted access.
Third-party services. BIM VPN may integrate third-party services or content. BIM VPN has no control over and assumes no responsibility for third-party content, privacy policies, or practices. Your use of third-party services is governed by those parties' own terms.
Accuracy and timeliness not guaranteed. Information provided through the Service or support channels is for general informational purposes only. BIM VPN does not warrant the accuracy or completeness of any information provided.
To the maximum extent permitted by applicable law, BIM VPN shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service.
Severability. If any provision of this Protocol is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The invalidity of one provision shall not affect any other provision, which shall remain in full force.
Actual locations and speeds may vary. Server locations listed by BIM VPN represent general geographic regions and may not reflect precise physical server locations. Connection speeds depend on your local network conditions, device, and geographic distance to the server, and may vary significantly from advertised speeds. BIM VPN does not guarantee specific performance metrics.
Right to interpret. BIM VPN reserves the right to interpret, apply, and enforce the terms of this Protocol. In the event of any ambiguity or dispute regarding the meaning of any provision, BIM VPN's reasonable interpretation shall apply, subject to applicable law.
Governing law. This Protocol shall be governed by and construed in accordance with the laws of the British Virgin Islands. Any disputes arising under this Protocol shall be subject to the exclusive jurisdiction of the courts of the British Virgin Islands.
